Justice Abubakar Baba Shani of the Federal Capital Territory High Court, Apo, Abuja, yesterday admitted further exhibits in the suit brought by Simitex Engineering Company Limited against Red Sapphire Nig. Limited and three others for additional construction work carried out on a property in Abuja.
During the hearing, counsel to the claimant, A. T. Abdulkareem, led Principal Witness One (PW1), Ibrahim Tajudeen, in evidence. He continued his testimony by confirming official documents related to their relationship with their former landlord, Red Sapphire Nig. Limited, the first defendant.
Also named in the suit, marked No: FCT/HCHC/CV/4160/2024, are the Minister of the Federal Capital Territory; the Director, Parks and Recreation Department, Abuja; and the Director, Department of Development Control, Abuja, as the 2nd, 3rd and 4th defendants.
Simitex instituted the action against the defendants over claims of additional construction work valued at over N250 million on a building known as Plot No. 1772 AOI Garki District, also referred to as Abuja Zoological Garden, Treasure Island, Nasarawa Street, Area 1, Abuja.
The defendants had initially approved the work, but failed to provide funds after re-acquiring the property.
The claimant’s counsel presented six pictures and a document to PW1, who identified them. The documents were admitted as Exhibits G, G1 to G5, with the Windows Search document marked as Exhibit H.
PW1 confirmed the property in the pictures through its red roof and trees, noting that further reconstruction work was done with red bricks and that workers were captured in some of the images.
He also verified the Windows Search document, stating that it was printed from the Corporate Affairs Commission (CAC) website and contained information about the government’s Eagle Watch and Project Accountability Initiative.
Defence counsel, Promise Choko, did not object to the admissibility of the documents, which were admitted.
When questioned about the Bill of Quantities, PW1 confirmed its designation as Exhibit I.
After arguments from both parties, Justice Shani reserved a decision on the admissibility of the Abuja Magistrate’s Court processes, which had ruled in favour of the claimants.
The court adjourned until October 9, 2025, for ruling on the court processes and cross-examination of PW1.
In their writ of summons, the claimants requested reimbursement for construction expenses incurred on three rooms on the property.
They sought a court order directing the defendants to settle the construction costs before vacating the premises, as stated in their letters of demand.
The claimants also requested an order preventing the first defendant from using or renting out the constructed office space until full payment is made.
They further requested that the defendants jointly or severally pay N25 million as construction costs in respect of the three rooms built at Plot No. 1772 AOI Garki, also known as Abuja Zoological Garden, Treasure Island, Nasarawa Street, Area 1, Garki, Abuja.
