Two judges assigned to the upcoming trial of the medical team charged in connection with the death of Argentine football icon Diego Maradona will remain on the case, after a request for their removal was rejected on Wednesday.

Lawyers representing Leopoldo Luque, Maradona’s personal physician and one of seven defendants facing culpable homicide charges, had argued that two of the newly appointed judges might not be impartial. However, the judicial panel dismissed the motion, calling it “based on conjecture” and “speculation.”

This development follows the collapse of the first trial in May, after one of the presiding judges was revealed to have secretly participated in a clandestine documentary about the proceedings. A new three-member judicial panel was constituted in July to restart the trial.

A new date for the proceedings has yet to be announced.

Maradona, widely regarded as one of the greatest footballers of all time, died in November 2020 at the age of 60, two weeks after undergoing brain surgery. The official cause of death was heart failure and acute pulmonary edema a condition marked by fluid buildup in the lungs.

Prosecutors allege that the star’s medical team acted with gross negligence during his recovery at home, contributing to his untimely death. If convicted of “homicide with possible intent”  a charge implying the accused knew their actions could be fatal but proceeded regardless  the defendants face sentences ranging from eight to 25 years in prison.

The case continues to draw intense public and media scrutiny in Argentina and around the world.
