The Social Security Administration (SSA) has announced plans to implement President Donald Trump’s executive order restricting automatic birthright citizenship, following similar moves by the United States Citizenship and Immigration Services (USCIS) and the Department of State.

Under current U.S. law, children born on U.S. soil automatically acquire citizenship regardless of their parents’ immigration status. However, the new executive order aims to redefine this longstanding interpretation of the 14th Amendment by limiting birthright citizenship to children with at least one parent who is either a U.S. citizen or a lawful permanent resident (green card holder).

While the executive order has yet to be ruled upon by the courts, federal agencies are moving forward with preparations for its implementation.

The SSA plays a crucial role in issuing Social Security Numbers (SSNs), a process that typically relies on documentation such as U.S. birth certificates. However, under the new directive, birth certificates alone will no longer be deemed sufficient proof of citizenship for those born after the order’s effective date.

To comply with the new rules, the SSA will require additional documentation demonstrating that at least one parent was a U.S. citizen or held an eligible immigration status at the time of the applicant’s birth.

“A birth certificate showing a U.S. birthplace will not automatically qualify as proof of citizenship,” an SSA official stated, noting that manual revisions and new training procedures are already underway.

For applicants born after the EO’s implementation date, the SSA will require:

  • A U.S. birth certificate plus documentation proving parental citizenship or legal immigration status at the time of birth.
  • For parents claiming U.S. citizenship:
    • Certificate of Naturalization or Citizenship
    • Valid U.S. passport issued under the EO
    • Consular Report of Birth Abroad
    • U.S. Citizen ID card
    • DHS or State Department verification, or federal/state court records

For parents claiming lawful permanent residency:

  • Permanent Resident Card (Green Card)
  • Machine-Readable Immigrant Visa (MRIV) with I-551 notation
  • Verified DHS or federal records confirming permanent residency

In cases where the mother claims lawful presence based on asylum or refugee status, a stamped Form I-94 or equivalent evidence must be presented.

The SSA will update internal policy manuals and revise the Enumeration at Birth program to accommodate these changes. Specific procedures will be outlined for situations where:

  1. Parents do not apply for their child’s SSN at birth, or
  2. An individual requests a replacement card under the new EO framework.

The agency emphasized that the changes aim to align with federal law and prevent unauthorized claims of citizenship under the redefined criteria.

Legal experts warn that the executive order, if upheld, could have far-reaching implications for millions of families, particularly those in the U.S. on temporary visas such as H-1B and F-1, or without legal status.

The policy also means that even newborns in the U.S. would face additional scrutiny to establish their citizenship status, a move that critics argue challenges fundamental constitutional protections.

While legal challenges are anticipated, agencies including the SSA, USCIS, and the Department of State are preparing for a full-scale rollout pending judicial clarity.
