The Supreme Court of Nigeria has released the full judgment in case involving the Rivers State Local Government Election held on October 5, 2024.

The judgment, delivered earlier today by Justice Jamilu Tukur Yammama, declared the election invalid due to breaches of the Electoral Act 2022 and the 1999 Constitution of Nigeria (as amended).

  • The Court upheld the Federal High Court’s decision, which found that the Rivers State Independent Electoral Commission (RSIEC) and the Independent National Electoral Commission (INEC) failed to comply with statutory provisions governing voter registration and election notices.
  • The election was declared invalid under Section 150(3) of the Electoral Act 2022, which mandates that any Local Government Election conducted in violation of the Act shall be null and void.
  • The Supreme Court restored all reliefs granted by the Federal High Court, emphasizing the importance of adhering to legal frameworks in electoral processes.
