A Senior Advocate of Nigeria (SAN), Chief Emeka Obegolu, has written to the Inspector-General of Police, drawing attention to an alleged violation of a court order and contemptuous actions by officers of the Nigeria Police Force.

In a letter dated 11th March 2024, Chief Emeka Obegolu, SAN, informed the IGP of recent developments surrounding a fundamental rights enforcement suit filed by his client, Mr. Chinedu Nwosu, against the Economic and Financial Crimes Commission (EFCC) and six others.

According to the letter, Nwosu, a businessman from Nnewi, Anambra State, had previously been detained by the EFCC and the National Central Bureau (NCB) following allegations of financial impropriety leveled against him by his former Taiwanese business partner, Ms. Hui Fang Hung.

Despite being released without charges after investigations, Obegolu stated that Hung continued a “vindictive campaign” against Nwosu, leading to further harassment by the police.

Fundamental Rights Suit and Court Order
In February 2024, Nwosu approached the Federal High Court in Abuja to enforce his fundamental rights. Justice J.O. Abdulmalik issued an interim order on 28th February, mandating all parties to maintain the status quo pending the determination of the substantive suit.

Obegolu stated that a copy of the court order was forwarded to the office of the IGP on 4th March 2024.

Alleged Contempt and Violation
However, on 11th March 2024, officers from the Divisional Police Headquarters in Asaba, Delta State, allegedly arrested Nwosu’s wife, Mrs. Nwosu May Ifeanyichukwu, from their residence, despite her informing them about the court order.

The letter claimed that Mrs. Ifeanyichukwu was subsequently transferred to the Force Criminal Investigation Department (FCID) in Abuja, an action Obegolu described as “tantamount to contempt of a subsisting court order and violation of the rule of law.”

Request for Intervention
Obegolu requested the IGP’s intervention to secure the release of Mrs. Ifeanyichukwu, direct the FCID to comply with the court order, and instruct the Divisional Police Headquarters to refrain from arresting or detaining anyone related to the case pending the determination of the substantive suit.

The lawyer emphasized the fundamental objective of the Nigeria Police Force to uphold and safeguard the fundamental rights of every Nigerian citizen with due regard to the rule of law.
