A Lagos-based law firm, The Law House, has demanded the immediate release of their client, Mr. Idris Babatunde Igbin, who has been in police custody for over eight days without being charged.

In a letter dated March 7th, 2024 addressed to the Officer-in-Charge of the Special Anti-Kidnapping Police Department in Ibadan, Oyo State, the firm stated that Igbin was arrested on February 28th from his home in Ilaro, Ogun State by officers from the Ilaro Police Station.

He was subsequently transferred to the Ibadan unit on March 4th, bringing his total days in detention to over eight without any charges filed against him.

The lawyers argued that the continuous detention violates Igbin’s constitutionally guaranteed rights of presumption of innocence and freedom of movement as enshrined in Sections 36(5) and 35(4) of the 1999 Constitution.

Citing a Court of Appeal ruling in Olugbenga Adeniyi v. Federal Republic of Nigeria, the letter reminded the police that no person should be incarcerated unless convicted by a competent court after being proven guilty.

“Our client’s continued incarceration has prevented him from attending to his work since February 28th, risking the loss of his source of livelihood and further compounding the unemployment situation,” the letter stated.

It added that Igbin’s health has also deteriorated due to the continuous confinement by the officers.

The Law House gave the police a 24-hour ultimatum to release their client on self-recognizance or face a lawsuit to claim “extensive damages” for the alleged rights violation.

Copies of the letter were sent to the Commissioners of Police in Oyo and Ogun States, the Inspector General of Police, and the National Human Rights Commission among others.
