A non-profit organization, Personal Data Protection Awareness Initiative (PDPAI), has filed a lawsuit against Tulsi Chandrai Foundation Eye Hospital in Abuja for alleged violations of data privacy rights.

In an originating summons before the FCT High Court, PDPAI accused the hospital of using closed-circuit television (CCTV) cameras and patient information forms to collect personal data without displaying any privacy notices as required by Nigeria’s data protection laws.

The group said the hospital’s website also had no privacy policy to inform patients how their data would be used, shared, or retained. It added that no data protection impact assessments were conducted regarding some of the high-risk processing activities.

PDPAI is seeking several court declarations and orders compelling the hospital to comply with provisions of the Nigeria Data Protection Act 2023, the Nigeria Data Protection Regulation 2019, and the 1999 constitution, which guarantees the privacy of personal data.

It argued that the hospital’s actions amounted to a breach of statutory duties on lawful data collection and handling. The group, through its legal counsel, Okani Emmanuel of E.I. Okani & Associates, seeks court declarations that the hospital breached the provisions of the NDPA’s data handling requirements, an order compelling Tulsi Chanrai Eye Hospital to comply with privacy protection regulations, damages, and other relief.
