OBSCURE LEGAL FACTS BY AROME ABU
In Nigeria, it is an offence to take custody of an unmarried girl under the age of sixteen years from her parents or guardian.
Important notes
• Ignorance of the girl’s age is not a defence;
• it is immaterial that then offender thought the girl was above 16 years,
• it is immaterial that the girl was taken with her own consent or at her own request,
• A woman can also be found guilty of this offence.
PENALTY
Imprisonment for two (2) years
See Section 362 and 363 of the Criminal Code Act.
