The Federal Competition and Consumer Protection Commission (FCCPC) has suggested potential legal consequences for Erisco Foods following the company’s controversial arrest of a dissatisfied customer.

Speaking on Arise News, FCCPC CEO Babatunde Irukera cautioned that falsely accusing customers of criminal defamation can lead to charges of malicious prosecution. He revealed the agency has summoned Erisco to explain the arrest and provide documents.

Irukera advised Erisco was ill-advised to pursue a criminal matter for what he sees as “fair speech” and damage to their brand. He emphasized that harm to a company’s reputation is not a criminal conspiracy.

On police involvement, Irukera acknowledged their duty to probe allegations but warned against misusing law enforcement for non-criminal issues. He could not advise on civil liability but noted possible legal theories.

Irukera explained the FCCPC is still investigating and needs to gather evidence before deciding on potential penalties. He stated the Commission confronts even dominant firms over anti-competitive behaviour and makes independent decisions upholding fair competition.

The statements indicate Erisco Foods could face sanctions beyond reputational damage if the FCCPC establishes violations. Irukera stressed investigating alleged anti-competitive conduct thoroughly despite company size or status. His remarks signal more turmoil ahead for Erisco regarding the now-viral customer arrest incident.
