In the midst of an ongoing controversy surrounding the Isese Festival in Ilorin, the Nigerian Bar Association Section on Public Interest and Development Law (NBA-SPIDEL) has issued a strong call for the upholding and safeguarding of citizens’ rights to freedom of religion, peaceful assembly, and association in Nigeria.

Led by Chairman John Aikpokpo-Martins and Secretary Funmi Adeogun, NBA-SPIDEL emphasizes the constitutional significance of protecting individuals’ right to practice their religious beliefs. The association points to the provisions of the 1999 Constitution of the Federal Republic of Nigeria, particularly sections 38(1) and 40, which guarantee and sanctify this freedom for every citizen of Nigeria.

The recent focus of attention centers on the Ilorin Council of Ulama’s declaration that the traditional Isese Festival be suspended. This directive specifically targets members of the International Council for Ifa Religion (ICIR) who plan to observe the festival in Ilorin. In response, NBA-SPIDEL has strongly condemned this action, deeming it a violation of the Nigerian Constitution and a potential catalyst for religious unrest.

NBA-SPIDEL raises concerns over a press release by the Nigeria Police Command, Kwara State, which echoes the sentiments of the Ulama’s declaration, rather than adhering to its constitutional responsibilities. The section reminds the police that their role includes safeguarding citizens’ rights, irrespective of their religious affiliations, and calls on them to provide adequate security and protection to ensure the peaceful exercise of religious practices.

The association underscores the principle that Nigeria does not have a state religion, as enshrined in Section 10 of the Constitution of Nigeria 1999. Thus, NBA-SPIDEL questions the basis on which the Ulamas declare the prohibition of a lawful religious practice within Ilorin.

In light of the brewing crisis, NBA-SPIDEL calls on the Government of Kwara State, the Inspector-General of Police, the Commissioner of Police, Kwara State Police Command, and all relevant security agencies to promptly address the situation. The association urges these authorities to uphold citizens’ constitutional rights and put an end to any unconstitutional restrictions on religious practices.

NBA-SPIDEL’s statement also encourages all involved parties to prioritize peace, harmony, and mutual respect, reflecting the true virtues of religious beliefs and traditions.
