*Give Me More Time To Study Your Video Evidence – Uba Sani

The governorship candidate of the People’s Democratic Party (PDP) at the March 18, 2023 election, Hon. Isa Ashiru has told election petition tribunal that he has a video evidence to tender before the court against the victory of the defendant, Uba Sani of the All Progressive Congress (APC).

This was even as Ashiru presented additional witness at the tribunal on Wednesday to testify against the victory of Uba Sani.

In a petition marked EPT/KD/Gov/4/23, Ashiru and his party, PDP, are challenging Gov. Uba Sani’s victory at the poll based on alleged non-compliance with the electoral Act by the INEC and other corrupt practices.

The lead counsel to the 1st and 2nd petitioners, Ashiru and PDP, Oluwole Iyamu (SAN) sought for the approval of the tribunal to present a video evidence and to also call a witness to give account on the exhibit brought before the tribunal in respect of the video.

However, Uba Sani’s lead Counsel, Duro Adeyele (SAN) requested before the tribunal, more time to study the video, saying that they were all served late, being the reason they are requesting for more time to study the content of the video.

“I was just served ten minutes earlier before now, so, there is the need to watch what is in the video. I requested that we should be given 24 hours to watch the video”. Adeyele said.

The PDP counsel who agreed to the respondents counsels’ request to be given more time to study the video admitted that, “It was not deliberate for us to have served them late. I apologise for that.”

One of Ashiru’s witnesses, Stephen Luka Bivan who appeared before the 3-man tribunal headed by Justice Victor Oviawe, told the tribunal that he has knowledge of the BVA’s machine, being an expert in Information and Communication Technology (ICT)

Mr. Bivan who was cross examined by the counsels to the 1st (INEC), 2nd ( Uba Sani) and 3rd (APC) respondents, also said that he is very much aware of the electoral process as regarding the last general elections.

When asked, if he had ever worked with INEC, or any electoral body, the witness who is a software expert said, “I have never worked with INEC or any other electoral body, but based on my knowledge as a software expert, I have knowledge of the BVA’s machine”.

The tribunal adjourned the case to Thursday, July 20, 2023 for the continuation of the cross examination.
