*Says If Jonathan Plans To Run Based On FHC Judgement Then APC Would Be In Trouble

A Former Chairman of the National Human Rights Commission, Prof. Chidi Odinkalu has questioned the judgement of the Federal High Court, Yenagoa Division, which declared Former President Goodluck Jonathan eligible to contest in the 2023 Presidential election.

Recall that on the 27th of May 2022, a Federal High Court in Yenagoa presided by Honourable Justice Isa H. Dashen in SUIT NO: FHC/YNG/CS/86/2022 declared Former President Goodluck Jonathan eligible to contest the 2023 Presidential Election.

The judgement appears to have put a full stop on all legal arguments on supposed legal impediments against the Former President’s eligibility to run again.

However, in response to the judgement, Prof. Odinkalu, a fiery rights activist and social critic warned the All Progressives Congress against relying on the judgement to field Jonathan in the 2023 Presidential election.

In a Twitter post sighted by TheNigeriaLawyer, he wrote: “The judgment in this case seeking to draft @GEJonathan into #NigeriaDecides2023 on the platform of @OfficialAPCNg is most interesting. I will not say more. But anyone or party who wants to found a presidential tenure on this judgment wld be well advised to think more than twice.

He continued: “Anyone who can make sense of this judgment & this highlighted order is more impressive than Einstein. If this is the judgment on which @GEJonathan plans to run again, then @OfficialAPCNg will be in serious trouble.”

In the part of the judgement highlighted, the Judge held:

“Consequently, I enter judgement for the 1st Defendant and all the reliefs sought by the Plaintiffs in their Originating Summons dated 16th of May, 2022 (but filed on 17th May, 2022) fail and are all hereby dismissed”
