A Former Chairman of the National Human Rights Commission, Prof. Chidi Odinkalu has raised alarm over an Ex-Parte order issued by a Delta State High Court sitting in Kwale with respect to the Presidential ambition of the Governor of the Central Bank of Nigeria, Godwin Emefiele which is currently subject to litigation at the Federal High Court, Abuja.

TheNigeriaLawyer recalls that the Governor of the Central Bank of Nigeria, Godwin Emefiele, on Monday, through his Counsel, Chief Mike Ozekhome SAN asked the Federal High Court, Abuja to interpreter the provisions of the Electoral Act and the 1999 Constitution as amended and to declare the CBN Boss as eligible to contest the 2023 Presidential election without resigning his present office.

In a twitter post sighted by TheNigeriaLawyer, the Human Rights Activist raised alarm about an Ex-Parte order issued by a Delta State High Court sitting in Kwale on the same subject matter contrary to a recently released directive by the National Judicial Council against duplicity of cases before Courts in the country.

In the Court Order posted by Prof. Chidi, the Court presided over by Honourable Justice D.C. Maidoh in the case between MR NKWO AUGUSTINE VS. THE BOARD OF THE CENTRAL BANK OF NIGERIA & INEC, upon consideration of an Ex-Parte application ordered that the Defendants be barred from treating Section 9 of the CBN Act as a bar on the CBN Governor from contesting for political office pending the determination of the Motion on Notice.

Section 9 of the CBN Act states that “the Governor and the Deputy Governors shall devote the whole of their time to the service of the Bank and while holding office shall not engage in any full or part-time employment or vocation whether remunerated or not, except such personal or charitable causes as may be determined.”

Odinkalu tweeted, “2 days after the NJC issued a directive on multiplicity of actions, one Mr. Maidoh sitting as the High Court of Delta State, without competence or jurisdiction, issues an ex parte order effectively requiring #EmefiOle to destroy @cenbank. Mr. Maidoh has to go as a judge. Period!”
