#OBSCURELEGALFACTS BY AROME ABU

WHEN A DOCTOR IS REQUIRED TO OBTAIN COURT ORDER IN ORDER TO TREAT A PATIENT

In Nigeria, where a child under age 13 is in need of medical care, but his parents withhold consent, the Doctor may obtain a Court order in order to protect the child’s health interest.

A medical practitioner who stands by and watch his young patient die under avoidable circumstances may be charged for negligence.

See Rule 39(c)(iii) of the Rules of Professional Conduct for Medical and Dental practitioners.
