An Abia based Human Rights lawyer, Emperor Gabriel Ogbonna, has filed a committal application against the Director-General of the Department of State Service, (DSS) Yusuf Bichi, for allegedly disobeying a court order granting him bail.

The Motion which was made available to TheNigeriaLawyer (TNL) dated 3rd day of August, 2020 is brought before the Abuja Division of the Federal High Court pursuant to Order 35 Rules (2B) and Rule 2 of the Federal High Court (Civil Procedure) Rules, 2019 and under the inherent powers and jurisdiction of the court

“AN ORDER of this Honourable court, committing Yusuf Magaji Bichi, the Director-General of the Department of State Security Service to prison and detained in custody until he obeys the order of this honourable court made on the 29th of June 2020.” the relief on the face of the Motion reads

Among the grounds for the application is that the court ordered the DSS on the 29th of June, 2020 to release Ogbonna. However, “despite the service of the judgment on the Director-General of the DSS, on the 2nd of July, 2020, he has continued to hold and detain the Applicant, Emperor Gabriel Ogbonna Esq, in Utter disregard and disobedience to the orders of this Honourable Court.”

Another ground for the application is that “the health and life of the Applicant are now in grave danger due to his lengthy incarceration and continued detention by Director-General of the Department of State Security Service in total disregard of the order of this honourable court made on the 29th of June 2020, and served on the Director-General of the Department of State Service on the 2nd of July 2020.”

TNL recalls that Emperor was arrested for criticizing Governor Ikpeazu of Abia State on his Facebook post. He was consequently arraigned before the Magistrate Court sitting at Umuahia North Local Government Area of Abia State on a two-count charge.

The charges border on Cybercrimes; Cyber Terrorism and intentionally publishing false and threat messages through the internet against the governor of the state, Dr. Okezie Ikpeazu which could cause ill-will and hatred against the Governor of the state.
