The legal Adviser to Akwa Ibom State chapter of the Peoples Democratic Party (PDP), Godwin Umoh, yesterday described Senator Godswill Akpabio’s claim that he moved and not defected to the All Progressives Congress (APC) as unknown to law, or the constitution of the party and that of the country.

Akpabio, the former Senate Minority Leader and former Governor of Akwa Ibom State had through his lead counsel, Sunday Ameh, told a Federal High Court sitting in Abuja that he was suspended and expelled by the Peoples Democratic Party (PDP) in a suit seeking his removal and that of 53 other members of the National Assembly.

He described the suit, which was filed on account of the lawmakers’ defection in 2018 from PDP to APC as incompetent.

The lawmaker told Justice Okon Abang that an advocacy group, Legal Aides Assistant Project, instituted the case without a locus standi, asking the court to dismiss the suit.

This was as he argued that LEDAP was not a political party or a member of the National Assembly and as such, it could not advocate for the political party from where the lawmakers decamped.

Relying on Section 40 of the 1999 Constitution, Akpabio had justified his movement in what he referred to as ‘an uncommon’ situation within the PDP, which compelled him to opt to the All Progressives Congress as an alternative party to actualise his political interest.
