Legal practitioner, Vincent Adodo, Esq., has raised alarm over the prolonged delay by Ondo State Governor, Hon. Lucky Orimisan Aiyedatiwa, in constituting a full State Executive Council more than 60 days after his inauguration on February 24, 2025. Adodo warned that the delay violates constitutional provisions and undermines inclusive governance.

In a detailed legal commentary issued on Saturday, 17th May 2025, Adodo noted that although Governor Aiyedatiwa nominated two commissioners—Dr. Olukayode Ajulo, SAN, OON as Attorney-General and Mrs. Omowunmi Isaac as Commissioner for Finance—within 24 hours of assuming office, no further appointments have followed, leaving many critical sectors in limbo.

He cited Section 192(6)(a) of the 1999 Constitution (as amended), which mandates that the nomination of commissioners must be done within 60 days of the governor taking the oath of office. Adodo argued that the failure to fully constitute the council breaches this constitutional timeframe and runs afoul of Sections 192(2) and 14(4), which require the appointments to reflect the diversity of the state.

“The current structure of the Executive Council, with only two commissioners, cannot validly satisfy the constitutional mandate for inclusivity and adequate representation across the state’s diverse regions,” Adodo stated.

He also highlighted the consequences of this vacuum, stressing that critical sectors such as health, education, land administration, youth and sports, and agriculture remain without direction or leadership.

Adodo emphasized that the appointment of special advisers and aides cannot substitute for commissioners, who are the only political appointees constitutionally empowered under Section 193(2) to meet with the Governor and Deputy Governor to determine the policy direction of the state.

He described the ongoing delay as a “serious breach” of the Constitution and urged Governor Aiyedatiwa to “immediately remedy the defect” by appointing a full complement of commissioners, ensuring they reflect the state’s federal constituencies in line with the principles of federal character and inclusiveness.

According to Adodo, “It is hoped that in no distant time, the Governor would take conscientious steps to rectify this fundamental constitutional defect by nominating commissioners that reflect the diversity and needs of Ondo State.”
