The Eyinatayo Fiasco:

On August 15, 2022, it was reported that Eyinatayo Iluyomade, a 19-year-old Nigerian comedian, landed himself in prison after a prank went awry. Mr Eyinatayo, woke up and thought it was a good day to send a note to the First Bank, Sabo Branch in Ondo town, threatening that he and other members of his gang would rob the bank at 1 pm. Banks in Ondo town, on account of this supposed joke/prank, taken too far, shut down for the whole day. Mr Eyinatayo was subsequently arrested and charged to court on three count-charge bordering on conspiracy, threat, and manner likely to pose a security threat.

To understand how worrisome Mr Eyinatayo’s actions were, it is important to note that just two weeks prior to his prank, gunmen had attacked a police division in Okuta Elerinla, Akure, resulting in the death of a police officer. Additionally, a tragic assault had taken place on June 5th, 2022, at St. Francis Catholic Church in Owo, claiming the lives of at least 41 individuals and leaving several others injured. And so when the bank received the “prank” note, it is understandable why it would, alongside other banks, closed down for the whole day.

During the court proceedings, our dear Mr. Eyinatayo, who identified himself as a comedian and prankster, pleaded for mercy and our “understanding” and even brought to our kind attention that he had previously carried out such pranks while in Lagos and that there was never “any other gang members”. He expressed remorse for his actions and assured the court that he would not repeat such pranks.

But the Court would have none of that, as he was reportedly refused bail by the trial magistrate, Mosunmola Ikujuni, pending the apprehension of other members of the ‘criminal gang’. This incident, for me, is a stern reminder of the delicate balance between the craving for entertainment, trends, and “clouts” vis-à-vis public safety, especially in an environment marked by heightened security concerns.

The Warnings by the FPRO, CSP Olumuyiwa Adejobi

Like a prophet, on June 17, 2023, the Force Public Relations Officer (FPRO), CSP Olumuyiwa Adejobi, made a video. In the video, he issued a warning to comedians and skit makers who engage in pranks, urging them to regulate their activities as they are putting Nigerian lives at risk. He emphasized that prank masters and skit makers should avoid engaging in dangerous and unlawful activities that could endanger people’s lives or subject them to dehumanization. The FPRO highlighted an incident where a skit maker used a dummy gun for a prank, emphasizing that such actions could lead to misunderstandings with law enforcement officers. The FPRO also inferred to a popular skit maker who physically assaulted Nigerians in his pranks, stating that this behavior was becoming an offense and should be regulated, noting that the police’s message does not aim to prohibit skit makers from practicing their craft but rather to raise awareness about the potential dangers associated with their activities, promoting safety, avoiding harm to individuals, and ensuring compliance with the law.

The Trinity Guy Fiasco

No sooner than this warning was issued than a viral video surfaced showing a popular content creator, Abdullahi Maruf Adisa, AKA Trinity Guy, forcing a female minor, to give a description of his male genitalia. On Thursday 22nd of June, 2023, a formal invitation was extended to Trinity Guy by the Oyo State Police Command in connection with the obscene viral video where the female minor was sexualized in the reprehensible dialogue on the color of his genitalia. On Friday, the 23rd of June, 2023, the command confirmed that the prankster/comedian reported at the Command at exactly 10 am on that day.

The Oyo State Command has further updated that “Preliminary Investigations revealed that the obscene video which was a clear violation of Sec. 32,35 and 36 of the Child Rights Act of 2023 depicts explicit sexual exploitation of the minor who was compelled to give disturbing descriptive details of a Male genital.” In addition, the Skit Maker during the course of the interview provided shocking revelations about the involvement of the minor’s parents before, during, and after the production. “He particularly emphasized that the consent of both parents was sought before uploading the skit on the internet.

The Nigerian Police Force Public Relations Officer, CSP Olumuyiwa Adejobi, has further disclosed, via Twitter that the embattled skit maker and prankster, Trinity Guy, will appear before the court on Monday, 26th June, 2023, over the alleged inappropriate use of the minor in the skit video.

The Seriousness of Protecting Minors

Again, this case, amongst others, has highlighted the seriousness of protecting minors from exploitation and emphasized the need for accountability in the digital content industry. The inclusion of minors in pranks raises serious concerns about their welfare and protection. Minors are particularly vulnerable and may not fully comprehend the consequences or implications of participating in pranks. It is crucial to prioritize their safety, well-being, and rights, ensuring that their involvement is based on informed consent and that appropriate safeguards are in place to protect them from any harm or exploitation.

Implications

Potentially dangerous pranks could lead to harm or legal consequences. While the intention behind such a prank may be to entertain or elicit reactions, it carries significant risks that can escalate quickly and cause harm or panic among unsuspecting onlookers. And indeed, the dangers associated with such pranks are manifold. There is a genuine risk of physical injuries to those involved or innocent bystanders who may inadvertently get caught up in the commotion. Additionally, the psychological trauma inflicted on witnesses who may genuinely believe they are witnessing a real and violent incident cannot be overlooked. Moreover, pranks could potentially incite violence or retaliation from individuals who may intervene or perceive the situation as a genuine threat.

From a legal perspective, law enforcement authorities take a serious view of potentially harmful pranks as is the case with the Trinity Guy and the Eyinatayo Iluyomade fiasco. Even if no actual damage or loss of life occurs, content creators can be arrested and prosecuted for their actions. Pranks that involve extreme carelessness, negligence, and threats to life can lead to charges of criminal negligence, criminal assault, and endangering lives. It is essential to understand that the intention of creating a skit or engaging in playful behavior is not a valid excuse if the actions involved pose a genuine threat, cause harm, or result in injury.

Moreso, content creators must take responsibility for their actions. When participating in pranks or creating content, it is crucial to prioritize responsibility and consider the potential consequences of one’s actions. The safety and well-being of oneself and others should always be the foremost concern. Engaging in pranks that simulate violent altercations in public spaces not only puts the participants at risk but also endangers the lives and safety of innocent bystanders. By exercising caution and responsibility, content creators can ensure that their pranks remain harmless, entertaining, and free from potential harm

Data and Privacy Concerns

Pranksters’ disregard for privacy, data privacy, and consent extends beyond ethical boundaries and also carries significant security implications and health concerns. By not seeking consent or respecting privacy, pranksters expose individuals to potential security risks, both physical and digital. For instance, pranks involving trespassing or invasion of personal space can lead to heightened anxiety, fear, and even physical harm. Additionally, pranks that involve sharing personal information or capturing sensitive data without consent can result in identity theft or other malicious activities.

Health Concerns

Moreover, the health implications of certain pranks should not be taken lightly. Some pranks may cause extreme stress, panic attacks, or emotional trauma, which can have long-lasting effects on the mental well-being of those involved. Pranks that involve dangerous stunts or activities pose a direct risk to physical health and safety, potentially leading to accidents, injuries, or even fatalities.

Recommendations

In light of the disregard for privacy, consent, and the potential security and health implications associated with pranks, it is imperative to advocate for formal regulation and increased awareness surrounding this form of entertainment. Pranks should not be exempt from ethical standards and legal frameworks that protect individuals’ rights and well-being. By implementing regulations, authorities can establish clear guidelines and standards that ensure pranks are conducted responsibly, with respect for privacy, consent, and the safety of all parties involved.

Sensitization campaigns and educational initiatives are also essential to raise awareness about the potential implications of pranks. It is crucial to inform both content creators and audiences about the importance of obtaining consent, respecting privacy, and considering the potential psychological, physical, and security risks associated with pranks. Promoting responsible behavior and encouraging a culture of empathy and understanding will foster a safer and more respectful environment in the realm of entertainment.

Furthermore, collaborations between law enforcement agencies, social media platforms, content creators, and relevant stakeholders can facilitate the development and enforcement of comprehensive guidelines for pranks. These guidelines should emphasize the importance of consent, privacy protection, and the avoidance of activities that may endanger the physical or mental well-being of participants.

By formalizing regulations and increasing awareness, we can strike a balance between entertainment and ethical considerations. This will not only protect individuals from potential harm but also promote a healthier and more responsible approach to pranks. Let us strive for a culture that values consent, privacy, and the well-being of all, ensuring that pranks can be enjoyed without crossing ethical boundaries or jeopardizing anyone’s safety.

Conclusion

And so while the Trinity Guy goes to court on Monday, I can only hope that he receives a fair and just trial that appropriately addresses the allegations against him. For me, this case serves as a stark reminder of the need for greater accountability within the realm of content creation, particularly when it involves minors and sensitive subject matter. It is essential that the court considers the gravity of the situation and the potential long-term effects on the individuals involved.

This incident highlights the broader issue of irresponsible behavior and the potential harm that can arise from pranks and content that violate privacy, exploit individuals, and disregard legal and ethical boundaries. It serves as a wake-up call for society to recognize the need for formal regulation, awareness, and accountability in the world of pranks and content creation. By addressing these issues head-on, we can strive for a safer, more responsible, and ethically sound entertainment industry that respects the rights and well-being of all individuals involved.
