Skipper Eye-Q Nigeria Limited, a specialist eye care services provider, has expressed its dissatisfaction with the Personal Data Protection Awareness Initiative’s use of online media to serve them a court process. The company has described this act as subjecting them to a media trial.

In a letter dated March 4, 2024, written by the law firm of Layi Babatunde SAN & Co. and signed by Olabode D. Owoeye, Esq., Skipper Eye-Q Nigeria Limited addressed the issue and made the letter available to TheNigerialawyer.

The letter was written in response to a widely circulated release published on February 23, 2024, titled “NGO SUES SKIPPER EYE- Q CLINIC FOR ALLEGED BREACHES, SAYS CLINIC BROKE LAW BY NOT INFORMING PATIENTS OF DATA COLLECTION.” The company stated that they were never served with any court processes issued or referenced in the publication.

Skipper Eye-Q Nigeria Limited emphasized that media trials have no place under Nigerian law and are widely condemned by well-meaning individuals. The company further stated that circulating information related to a suit that has not been served on the purported defendant is most unexpected of any responsible organization.

“Media Trial is not a practice that Legal Practitioners should be found engaging in under whatever guise or manner and worse still, in a situation where our client has not been served with any alleged court process.

For the records, we have our client’s instructions to receive the court process, if that will expedite service of the court process on them and be rest assured that our client will treat such receipt as proper service, for the purpose of attending to your claims and the court proceedings that may ensue,” the letter partly reads.

In a bid to find out the reason behind the delay in serving the court process to the respondent, TheNigerialawyer’s inquiry to the court shows that the case is yet to be assigned.
