SEARCH OF THE OPPOSITE SEX BY A POLICE OFFICER, WHEN PERMITTED

Generally, in Nigeria whenever it is necessary for a Police Officer to search an arrested person, such search must be carried out by a Police Officer of the same sex as the person arrested. However, a Police Officer can search a person of the opposite sex:

•where the urgency of the situation makes it impracticable for an officer of the same sex to carry out the search.

•For the purpose of taking any instrument of violence or poisonous substance from the person arrested
