The suspened Executive Committee of the Nigerian Bar Association Section on Public Interest and Development Law (NBA-SPIDEL) has filed a petition with the Legal Practitioners Disciplinary Committee (LPDC), requesting disciplinary proceedings against the outgoing NBA President, Mr. Yakubu Maikyau SAN, and members of the NBA-SPIDEL Caretaker Committee, including Mr. Steve Adehi SAN (Chairman), Mr. Yakubu Philemon SAN (Co-Chairman), and Mr. Ben Oji (Secretary), for alleged professional misconduct.

The petition, signed by Mr. John Aikpokpo-Martins and Ms. Funmi Adeogun on behalf of the NBA-SPIDEL members, accuses Mr. Maikyau of violating the Rules of Professional Conduct for Legal Practitioners, particularly Rules 1 and 30, by allegedly disobeying valid court orders and disrespecting the principles of lis pendens in pending cases.

The petitioners claim that Mr. Maikyau, as the President of the NBA, has brought the legal profession into disrepute through his actions and has not upheld the rule of law or respected due process in discharging his duties. They allege that he willfully disobeyed a Delta State High Court order and unlawfully withdrew funds from the NBA-SPIDEL account while related cases were pending.

Furthermore, the petition states that despite being served with a court order restraining the NBA from holding the “NBA-SPIDEL 2024 Annual Conference,” Mr. Maikyau proceeded to host and organize the event on July 18, 2024. The petitioners claim that an application to commit Mr. Maikyau to prison for disobedience of the court order has been filed and is pending before the Delta State High Court.

The NBA-SPIDEL Executive Committee is urging the LPDC to commence disciplinary proceedings against Mr. Maikyau, Mr. Steve Adehi SAN, Mr. Yakubu Philemon SAN, and Mr. Ben Oji for their alleged failure to uphold the rule of law, promote the cause of justice, maintain a high standard of professional conduct, and for engaging in conduct unbecoming of legal practitioners.

This development follows the dismissal of the NBA-SPIDEL Executive Committee by the NBA National Executive Council for allegedly usurping the powers of the NBA President. The committee has since taken legal action against the NBA to reverse its dismissal.
