The Benin Branch of the Nigerian Bar Association (NBA) has condemned the recent suspension of local government chairmen and their vice chairmen by the Edo State House of Assembly.
In a statement issued by the chairman of the NBA Benin Branch, Idemudia Osifo, the association described the action of the State House of Assembly as a violation of the rule of law, referencing an existing Supreme Court judgment.
The statement reads: “The NBA Benin expresses its profound sorrow and indignation over the events of Tuesday, December 17, 2024, which appeared to undermine the rule of law. The NBA Benin was appalled to learn that the Edo State Assembly suspended democratically elected local government chairmen under the pretext of misconduct.”
The NBA Benin also referenced the Supreme Court decision in AG of the Federation v. AG of Abia State & Ors (2024) LPELR-62576 (SC), which affirmed the autonomy of local governments, urging all actors to act within the boundaries of the law.
The statement further urged the Attorney General and other relevant authorities to advise in accordance with the law, emphasizing that the rule of law must be upheld above all.
