A man by the name Fesobi Adeyemo has petitioned the Chief Judge of Ondo State accusing the former Attorney-General and Commissioner for Justice of the state for allegedly taking over a case which he (Adeyemo) was prosecuting before the Magistrate Court 2, Oke Eda, Akure as Complainant.
This is contained in a statement made letter sighted by TheNigeriaLawyer titled “UNETHICAL BEHAVIOR OF MR. CHARLES TITILOYE IN CHARGE NO: MAK/59C/2018 COMMISSIONER OF POLICE AND OSALUSI MICHAEL” signed by Adeyemo himself and copied to the Nigerian Bar Association, NBA, Akure Branch
He said before the appointment of Titiloye as AG, the said Titiloye was the counsel for the Defendant in the case and had even cross-examined the PW1 who was Investigating Police Officer in respect of the case
“It is to be noted that I, as the Complainant did not and has no relationship with the Attorney General and has not requested for the Honourable Attorney General to take over my the prosecution of my case
“Sir, while I know that under the law the Attorney General can take over a case but not in this circumstance. It is an abuse of power and unethical behavior for Attorney General to do so when he has vested interest in the matter since he is the counsel representing the defendant and also sent a lawyer to defend the Defendant and now sent a lawyer from the Ministry of Justice to take over the case…” he said
He, therefore, urged the Chief Judge to investigate the matter “to prevent pervasion of Justice by Mr. Charles Titiloye”
Recall that Titiloye has few days ago discontinued a case relating to one Pelumi, who claimed to be a half-brother of the state Chief Judge, Justice Akeredolu. Pelumi had in a viral video, accused the state CJ of remanding him without trial for three years, for going into his father’s house in Akure, the state capital.
But the judge said she had no hand in the detention of her purported half-brother, saying the matter was the handiwork of some persons who wanted to use Pelumi against her family. The state governor, Rotimi Akeredolu, had ordered the state attorney-general to investigate the matter.
