The presiding officer, Alhaji Umar Kagarko, ordered the defendant to produce one surety in like sum. Kagarko said that the surety must reside within the court’s jurisdiction and adjourned the case till April 18 for hearing. Bala, a resident of Wassa village, Apo, Abuja was on a four-count charge of criminal trespass, house breaking, mischief and theft. The defendant also rent out the property to another without the consent of the owner at the rate of N40,000. The Prosecutor, Adeniyi Oyeyemi, had told the court that Zimako Okubiuro of Wassa Estate, Apo, Abuja, reported the matter at the Apo Police Station on Feb. 9. Oyeyemi said the defendant criminally broke into the complainant’s house sometime in January while the he was away for Christmas and New Year holiday with his family. He said the defendant stole the complainant’s generator valued N70,000, Home theatre music set valued N140,000, mortar and pistol valued N10,000, farm produce valued N75,000 and N5,000. The prosecutor said the defendant also removed the complainant’s remaining property out of the house and dumped them in an unsafe location. He said the defendant rented the said apartment to another person at N40,000 without his consent. He said the offences contravened Sections 348, 355, 327 and 287 of the Penal Code.
