The National Drug Law Enforcement Agency (NDLEA) has clarified that the substantive drug trafficking case against suspended Deputy Commissioner of Police Abba Kyari is still ongoing and will continue before the Federal High Court in Abuja on Monday, March 16, 2026.

The clarification follows a recent judgment by Justice James Omotosho, who discharged and acquitted Kyari and his two brothers in a separate 23-count charge relating to alleged non-declaration of assets.
In a statement, NDLEA’s Director of Media and Advocacy, Femi Babafemi, explained that the ruling concerns a different case involving money laundering and asset declaration issues, and does not affect the agency’s primary drug prosecution.
According to him, the main drug-related charges against Kyari remain pending before Justice Emeka Nwite of the Federal High Court, Abuja, and proceedings are expected to continue as scheduled.
Babafemi noted that the agency’s legal team would first obtain a Certified True Copy (CTC) of the judgment delivered by Justice Omotosho in order to carefully review the court’s reasoning.
He added that after studying the ruling, the NDLEA would determine its next course of action, including the possibility of filing an appeal.
“First, I need to clarify that the ruling by Justice Omotosho is completely different from the main and substantive drug case, which continues before Justice Emeka Nwite on Monday. That one is very much on course,” Babafemi said.
Kyari, a former head of the Police Intelligence Response Team, has been facing multiple legal proceedings arising from allegations of involvement in drug trafficking and related offences.
