Senior Advocate of Nigeria (SAN), Sam Kargbo, stated during an interview on Africa Independent Television (AIT) that cases are assigned to judges based on their experience and competence to ensure proper justice delivery.

Kargbo made this comment while addressing concerns about the alleged manipulation of the judicial system, particularly in political cases.

He emphasized that the process of case assignment is rooted in fairness, with the Chief Judge (CJ) or the President of the High Court responsible for appointing judges with relevant expertise to handle specific cases. Kargbo clarified that judges themselves, having been exposed to numerous cases throughout their careers, are often selected for their experience in particular areas of law.

Addressing the controversial issue of assigning “special judges” to political cases, Kargbo dismissed such allegations as unfair, explaining that judges are not chosen to comply with political dictates but are instead selected for their knowledge and experience in the matter at hand. “The CJ would certainly assign a judge who has handled similar cases before, making the process more efficient,” Kargbo remarked.

He further highlighted that judges are responsible for their decisions, which will be scrutinized throughout their careers, and that any judicial ruling becomes part of their permanent legacy. When cases go to appeal, the focus shifts from just the parties involved to examining how the judge handled the case, impacting their reputation within the judiciary.

In conclusion, Kargbo warned against the notion that judges are assigned cases to further political agendas, stating that any judge who suggests such a thing is unfit for the bench.

He reiterated that judicial integrity and fairness are critical, and judges are expected to maintain these values in all cases they oversee.
