A United States judge has ordered Tyler Robinson, the man accused of killing conservative political activist Charlie Kirk, to stand trial after finding that prosecutors presented sufficient evidence to proceed with the criminal case.

Judge Tony Graf of Utah’s Fourth District Court delivered the ruling following a preliminary hearing during which prosecutors presented evidence allegedly linking Robinson to Kirk’s fatal shooting.
Robinson, 23, faces an aggravated murder charge as well as other counts, including felony discharge of a firearm causing serious bodily injury, obstruction of justice, witness tampering and committing a violent offence in the presence of a child.
The aggravated murder charge makes him eligible for the death penalty if convicted. Prosecutors have indicated their intention to seek capital punishment.
Kirk, 31, was shot in the neck on September 10, 2025, while addressing thousands of people at an outdoor event organised by Turning Point USA at Utah Valley University in Orem, Utah.
Prosecutors alleged that Robinson fired a high-powered rifle from the roof of a building approximately 140 yards away from where Kirk was speaking.
During the preliminary hearing, the prosecution relied on surveillance footage, DNA allegedly recovered from the suspected murder weapon and other forensic materials. Prosecutors also referred to messages and written statements in which Robinson allegedly admitted responsibility for the shooting.
The prosecution contended that Robinson targeted Kirk because of the activist’s political views, including his public positions on same-sex marriage and transgender issues.
His lawyers challenged the strength and reliability of the evidence, particularly the DNA findings and the prosecution’s claims concerning his alleged motive.
The defence also disputed the contention that the shooting endangered other people, arguing that the evidence indicated Kirk was the sole target.
Judge Graf, however, ruled that the prosecution had established probable cause to require Robinson to answer the charges at trial.
Following the ruling, one of Robinson’s lawyers entered a plea of not guilty on his behalf.
Robinson remains presumed innocent unless and until the prosecution proves the charges against him beyond a reasonable doubt.
A pretrial conference has been scheduled for October 23, when the court is expected to consider further procedural matters and possibly fix a date for the trial.
