*Implores The President To Ensure His Safety And Protection
*Prays For Investigation Allegations, Suspension Of Mr. Bichi As DG-SSS

Prominent Human Rights/Public Interest Litigation Lawyer, Maxwell Okpara has written through his Lawyers to the President of the Federal Republic of Nigeria, Bola Ahmed Tinubu, making a comprehensive report against, the Director General of the Department of State Security Service, alleging cyber bullying, intimidation and threat to life.

In a letter made available to TheNigeriaLawyer addressed to President Tinubu, Dated 19th July, 2023 and signed by the Deputy Head of Chambers, Maxwell Okpara and Associates, Anselm O. Oguguo, it was made known that the firm was acting as counsel for the complainant, Maxwell Okpara Esq.

The purpose of the letter as stated was to intimate the President on a matter which according to the letter: “poses a serious threat to the life and business of Maxwell Okpara Esq. “It has come to our attention that Mr. Yusuf Magaji Bichi, the Director General (DG) of the Department of State Security (DSS), along with his other personnel, has been involved in series of threats and harassment against the complainant, following the public interview wherein Mr. Maxwell Okpara Esq exposed the serial disobedient/violation of court orders by the institution of the SSS lead by Mr. Yusuf Magaji Bichi, the DG of DSS” the letter read.

Furthermore, the firm noted that the rule of law and respect of court decisions are the fundamental pillars of any democratic society and it was very much disconcerting to witness an executive authority, institutions and its officers openly defy the order of a competent court. They stated further that, the actions of the DG of DSS and its officers not only defy the principles of justice and fairness but also posed a threat to the life and well being of their client, the complainant.

Commenting on the alleged facts that led to the unwarranted threat, the letter made reference to the unlawful arrest of the Complainant’s client, Mr. Chidebere Echefu and subsequent application by the complainant to the court for the enforcement of his client’s fundamental right, wherein he obtained judgement in his favour on 11th March, 2022 as the Court ordered the release of the Applicant. However, according to the letter, the DG -DSS refused to comply with the court order and the applicant was yet to be released till date. The copy of the judgement and letter written to DSS was attached to the letter.

Also, reference was made to sometime in 2022 wherein it was alleged that the DSS grossly humiliated, assaulted and violated the right of the Maxwell Okpara Esq in the premises of the their headquarters in Abuja when he went to visit his client Mazi Nnamdi Kanu. On this basis, the Okpara Esq had instituted an action against DSS for enforcement of fundamental human right and the court had ruled in his favour, ordering the DSS to publish a written apology to Okpara on any National Dailies and pay 5m as damages. According to the letter, the DSS received the said judgement and refused to obey it. A copy of the judgement was attached.

Reference where made to other statement of facts particular the refusal to charge the suspended CBN governor despite publishing allegations against him on newspapers and the Federal High Court order that Emifiele be released within 7 days or be charged. Also, there was reference made to the address by the complainant to the video wherein the Complainant and other lawyers addressed the press calling for the President to relief the DG-DSS of his duty having failed to “raise the standard of democracy” the current administration seeks to build. Finally, reference was made to the tweet by the DSS Twitter page against the complainant, noting that the “complainant have suffered persistent calls based on the falsehood released by the DG-DSS”

In addition, the letter read thus: “Such acts of aggression against human right defenders have a chilling effect on the pursuit of justice and protection of basic human right. It should therefore be made known that if any legal attack is meted on the complainant , Barr. Maxwell Okpara and members of family, the DG-DSS, Mr. Yusuf Magaji Bichi should be held responsible as all his ignoble and clandestine strategy to hurt the complainant has been exposed by their offending and most ignoble publications against the complainant who is merely discharging his solemn duty and a lawyer duly called to the Nigerian Bar attempt has been made to shut him down by all means necessary.”

On the basis of all these, the Lawyers of Maxwell Okpara implored the President to ensure the safety and protection of their client, and prayed that the President carries out a thorough and partial investigation to the threat to life, derogatory/unprofessional comments capable of endangering peaceful practice of career, disregard to constituted authority, cyber bullying, intimidation by the DSS against the complainant, “as it was crucial for all those responsible for such actions be held accountable” the letter read; to help alleviate the fear and vulnerability of the complainant and his family; issuing a public statement condemning any form of intimidation, threats and violence against human right defenders and affirming the commitment of the DSS to protecting fundamental rights; order the suspension of Mr. Bichi as DG-DSS for deceiving the President, disobedience of court orders and intimidation of the complainant.

The lawyers concluded by emphasising the urgency of the matter and communicating the trust of Mr. President in guaranteeing justice and safeguarding the rights of individuals.
