The Federal Competition & Consumer Protection Commission (FCCPC) has arraigned Dr. Anuoluwapo Adepoju and Med. Contour Services Ltd over the death of one Mrs. Nneka Onwuzuligbo.

It was said that the events happened between 15th day of April, 2020 and 4th day of May, 2020 at No. 11a Ladi Alakija Street, Lekki Phase 1, Lagos.

They were arraigned before Hon. Justice Liman of the Federal High Court Lagos Division on a five-count charge.

It was revealed that the deceased died as a result of services rendered to her by the defendants and they have consistently preventing the course of investigation led by the FCCPC, noting that she has shunned summons extended to her in order to produce documents pertaining to the case.

TheNigeriaLawyer sighted a six paragraph affidavit deposed to by FCCPC on the completion of investigation annexed to the charge, it revealed that complaints were received from Taiwo Temilade, Marlene Oluwakemi and Vivian Onwuzuligbo where it was alleged that the services being rendered by the surgeon were “unsafe for customers consumers” and furthermore, that she made a misrepresentation about her marketing services.

“In particular, the above-mentioned Vivian Onwuzuligbo, a member of the Mrs Nnneka Miriam Barbara Onwuzuligbo (now deceased) alleged that the deceased died as a result of the failed defendants’ cosmetic surgery and she is privy to the events that led to the demise of the deceased.”

The counsel to FCCPC, Babatunde Irukera made it known that Adepoju acted contrary to sections 33(3)(a) and 113(4)(a) of the FCCPC Act 2018 and was liable to be punished under sections 33(3) and 113(1) of the same Act, among others.

Meanwhile, the defendant, however, pleaded not guilty to the five counts.

Justice Liman admitted her to bail on self-recognisance in view of the COVID-19 pandemic.

He adjourned till July 9 for commencement of trial.

Earlier in the proceeding, the judge dismissed a preliminary objection by the defence lawyer, Marian Jones, challenging the validity of the charges and the court’s jurisdiction to entertain them.
