The Election Petition Tribunal sitting in Ibadan, Oyo State, has dismissed the petition filed by the Social Democratic Party (SDP) challenging the victory of the Peoples Democratic Party (PDP) candidate, Hon. Folajimi Oyekunle, in the August 16, 2025, by-election for Ibadan North Federal Constituency.

The SDP had prayed the Tribunal to nullify the election that returned Hon. Oyekunle as the winner and declare its candidate victorious. The party also alleged that the election and return of Hon. Oyekunle were vitiated by non-compliance with the Electoral Act 2022, urging the Tribunal to cancel the by-election and order a fresh or supplementary poll in affected polling units.

Counsel to Hon. Oyekunle and the PDP, Tunji Ogunrinde, SAN, raised objections to the competence of the petition. He argued that the SDP failed to list its candidate as a party to the petition and prayed the Tribunal to dismiss the matter on these grounds.

Delivering judgment in suit number EPT/OY/HR/01/2025, the Tribunal, headed by Justice A.M. Yakubu, dismissed the petition, noting that the petitioner failed to prove the facts and grounds of the case.

The Tribunal further held that the evidence of the petitioner’s sole witness was contradictory, unreliable, and inadmissible.

Consequently, the petition was dismissed for lacking merit, and the Tribunal awarded costs of ₦2 million in favor of the PDP and Hon. Folajimi Oyekunle.
