In a move highlighting the growing concerns over data privacy and protection, a reputable Civil Society Organisation has lodged a petition with the Nigeria Data Protection Commission (NDPC) against DHL International Nigeria Limited.
The petition, dated 23rd August 2023, addresses the failure of DHL to deploy adequate privacy notices and potential non-compliance with data protection regulations.
The organisation, known as the “Personal Data Protection Awareness Initiative,” has been actively advocating for digital rights and privacy since its establishment in 2011. The petition raises concerns regarding DHL’s practices related to the collection and processing of personal data, which it claims violate the Nigeria Data Protection Act 2023 (NDPA) and the Nigeria Data Protection Regulation 2019 (NDPR).
The petition cites specific instances where DHL’s actions are alleged to contravene data protection laws. A visit to DHL’s office in Abuja reportedly revealed the absence of privacy-compliant visitor logs, potentially exposing personal data of visitors to unauthorized access. Furthermore, the petition asserts that the forms used for data collection and processing by DHL do not provide adequate information about how personal data is handled, violating Article 2.5 of the NDPR and Section 27 of the NDPA.
Additionally, the petition highlights concerns related to DHL’s closed-circuit television (CCTV) operations. According to the petition, there is a lack of signage informing individuals about the use of CCTV cameras and no readily available Privacy Notice addressing the capture and processing of data through these cameras. The organisation argues that DHL’s use of CCTV may not align with the necessary transparency and compliance standards set by data protection laws.
The Personal Data Protection Awareness Initiative is urging the NDPC to intervene and ensure that DHL adheres to data protection regulations. The organisation’s recommendations includes deploying comprehensive privacy notices on all data collection points, reviewing and revising CCTV activities to align with legal requirements, updating the privacy notice to reflect data processing activities and individual rights, and implementing technical and organisational measures to ensure the responsible use of personal data.
The organization remains hopeful that DHL will promptly take action to address the concerns outlined in the petition. The initiative underscores the significance of preserving individuals’ privacy rights and cultivating trust among both customers and the general public.
The petition, addressed to the National Commissioner of the NDPC, has been copied to various stakeholders including DHL’s Data Protection Officer, government and regulatory authorities, other civil society organisations, and media outlets.
The Personal Data Protection Awareness Initiative expects a response within 21 working days and remains committed to advocating for robust data protection practices in Nigeria.
