Barbara Tosan Onwubiko, Esq., the creator of the “NBA Decides” group, has issued a response to the disclaimer made by the President of the Nigerian Bar Association (NBA), Mr. Yakubu Chonoko Maikyau, regarding the group’s unauthorized polls.

In her letter addressed to the NBA President, Onwubiko clarified that “NBA Decides” is not a body but a group created on June 14, 2022, to share NBA-related media content and encourage full participation in NBA elections. She emphasized that the group’s polls were organized in a similar manner to other NBA social media groups and aimed to understand lawyers’ preferences and the popularity of candidates.
Onwubiko stated that the “NBA Decides” polls did not request or require NBA resources, privacy details, or the database of any voters (lawyers), and the group did not use the NBA’s logo, mark, or brand to warrant threats of criminal prosecution or petitions to the Legal Practitioners Disciplinary Committee (LPDC).
In light of the NBA President’s disclaimer, Onwubiko announced the cancellation of the polls scheduled for June 12th, 14th, and 16th, 2024, bearing all expenses incurred for their organization. She clarified that the cancellation was not an admission of wrongdoing but a decision made due to the potential impact of the disclaimer on participation and poll outcomes.
Moving forward, Onwubiko stated that the group would no longer be referred to as the “Nigerian Bar Association Decides” but instead as “LAWYERS DECIDES.” She expressed her disappointment with the NBA’s response and reaffirmed her commitment to the growth and advancement of the Bar.
The letter, along with the “NBA Decides” notice for the poll exercise, disclaimer, and logo, were attached as annexures to Onwubiko’s response to the NBA President.
