The court in its ruling, averred that the current executive of Onit­sha Main Market did not emerge through laid down procedure pro­vided by the constitution of the market. He cited that the market con­stitution provided for open secret ballot system of voting, while the electoral committee that conduct­ed the 10th February, 2016 elec­tion in the market opted for open ballot system which was not in line with the market constitution. The court maintained that it was not possible to uphold an election which did not follow the actual electoral procedure. It, therefore, ordered Mr. Chidozie Okeke and his executive to stop parading themselves as leaders of the market pending the determi­nation of the main suit. He subsequently directed the three zonal heads of the market to take charge of the affairs of the Onitsha Main Market as stipulat­ed by the Onitsha Main Market constitution. Reacting to the ruling, counsel to the respondent, Barr. Chukwu Ude, said he was not satisfied with the ruling, adding that his client would appeal the court’s decision. Counsel to the applicant, Barr. Obi Eregbuonye, told reporters that the court ruling favoured both parties as the injunction was made to create conducive atmos­phere in the market until the fi­nal judgment. Also reacting to the ruling, the Chairman of the market, Mr. Dozie Okeke, expressed wor­ry over the outcome and said his lawyers had been directed to ap­peal the court ruling.]]>
