Obscure Legal Facts By Arome Abu

An unaccompanied minor within the context of aviation is a child between ages six (6) to twelve (12) traveling on a commercial flight without the presence of a parent or guardian.

Most parents opt for this option because they consider it cheaper than booking for an accompanying adult. Also, some parents/guardians believe it develops a sense of Independence especially for older children.

Regulation 19.9.3.1(g) of the Nigeria Civil Aviation (Air Transport Economic) Regulation, prescribes the conditions for boarding unaccompanied minors and general procedure. They are as follows:

  • The unaccompanied minor is to be assisted with check-in, transfers, and boarding by airline ground staff.
  • Once on board, a flight attendant should observe and communicate with an unaccompanied minor periodically.
  • Unaccompanied minors should not be released to anyone other than the designated parent or guardian.
  • Details of the adult person at the destination must be provided by the parent and/or guardian during reservation.
  • Parents and/or guardians accompanying the minor to the airport should present a valid photo identification.
  • where upon arrival, the designated person fails to meet the unaccompanied minor at the destination airport, the airline is authorized to take such necessary actions that are in the best interest of the child. The parent/guardian would be required to reimburse the airline for any expenses incurred.

See Regulation 19.9.3.1(g) of the Nigeria Civil Aviation (Air Transport Economic) Regulation.
