A Nigerian firm, Cona Engineering and Technical Services Limited, has filed a lawsuit against a United Arab Emirates–based company, John Crane Middle East FZE, demanding over $10 million in damages for alleged multiple contractual breaches.

In suit No. FCT/HC/CV/323/2025 before the High Court of the Federal Capital Territory, Abuja Judicial Division, the plaintiff accused the defendant, located at S-20113 South Zone, Jebel Ali Free Zone 61040, UAE, of failing to honour agreed terms under a long-standing agency relationship.

Cona Engineering, through its counsel, Njemanze & Njemanze, is seeking a declaration that it is entitled to full commission payments due for products supplied or delivered to end users in Nigeria between October 1, 2020, and June 10, 2024. The plaintiff alleges that during this period, the defendant unilaterally refused to revert to the initially agreed 25 percent commission rate stipulated in the Agency Marketing Agreement entered into by both parties in Nigeria.

The company is also asking the court to declare that it is entitled to the same 25 percent commission for supplies allegedly made directly by the defendant to Nigerian end users in violation of the country’s local content regulations.

Among its monetary claims, Cona Engineering is demanding:

  • $60,481 as outstanding commission for supplies made between October 1, 2023, and June 10, 2024 (excluding the period from January 1, 2023, to June 27, 2023)
  • $9 million as unpaid agency commission for products allegedly supplied directly to end users, contrary to the Local Content Law Agreement
  • $1 million as damages for breach of contract

These claims bring the total sum sought to over $10 million.

The plaintiff stated that it has been the duly appointed agent of John Crane since 1996 based on a Marketing Agency Agreement, representing, marketing, and distributing the defendant’s mechanical seals and spare parts to clients in Nigeria’s oil and gas sector, including Nigeria LNG Limited (NLNG), Indorama, Nore, TSKJ Nigeria Limited, and Dangote Refinery and Petrochemical Nigeria Limited.

Cona said it made multiple attempts to resolve the dispute amicably, including requests for account reconciliation, but claimed the defendant declined, allegedly contrary to the internal rules of the Smiths Group, the parent company of John Crane Middle East.

No date has been fixed yet for the hearing of the suit.
