The Court of Appeal in Abuja on Friday evening upheld the dismissal of a N500M suit instituted against Fidelity Bank Plc by a political party, All Progressives Grand Alliance, APGA.

The Court lambasted APGA for instituting multiple court cases across the country as against the provisions of the law.

Upholding the judgment of a High Court of the Federal Capital Territory FCT, which dismissed APGA’S suit, Justice Mohammed Lawal Abubakar held that APGA’s appeal filed against the lower court was unmeritorious and baseless.

Justice Abubakar held that it was wrong of the APGA to be blowing hot and cold at the same time since doing so violates the provisions of the law.

APGA had asked the Abuja high court to award a whopping sum of N500M against Fidelity Bank for unlawfully freezing its account number 4010278117.

The party among others claimed that the action of the bank caused it serious embarrassment through the outright breach of bank and customer relationship.

But the high court in its judgment upheld the defense of the bank that the freezing of the account was based on a valid order of a Delta State high court obtained by the same party during its internal leadership tussle and served on it.

While dismissing APGA’S suit, the FCT court held that the freezing order on the account can only be lifted through the setting aside of the earlier order and not through a mere letter as done by the party.

Delivering judgment in the appeal filed against the Abuja High Court decision, Justice Abubakar held that the bank acted in line with provisions of the law.

In a unanimous judgment, the 3-man panel of the Justices held that APGA must get the earlier order of the Delta high court set aside before it can access the account and not through a mere letter.

Justice Abubakar said that APGA’s appeal was worthless, unmeritorious and that the party was not entitled to the N500M compensation demanded from the bank.

The Appeal Court proceeded to dismiss the appeal.
