Donarson Services Ltd, a construction firm in Uyo has accused Anchor Insurance Company Ltd of breach of contract.

In a case filed at High Court of Akwa Ibom in Uyo, with the Suit No: HU/ 54/2019, Donarson Services Ltd, is demanding the sum of N80,009237 for damages.

As stated in the statement of claim, Anchor Insurance Company Ltd had in November 2013, contacted Donarson Services Ltd to build new office complex at Wellington Bassey Way in Uyo, with the sum of N198, 390,843, which was successfully built by Donarson Services Ltd.

Upon taking over possession and commissioning the fully serviced apartments with lift ensuite building by Anchor Insurance Company Ltd, the insurance company neglected or refused to pay the overdue of N35, 409,327.98.

The defendant who was visibly impressed with the completed building by Donarson company brought the Executive Governor of Akwa Ibom to officially Commission the project and the entire Akwa Ibom State who were represented proudly approved the project.

The plaintiff further stated that the defendant has since paid other sub-contractors and due to the defendant’s default, Donarson’s business and reputation are seriously in jeopardy.

That Anchor Insurance admitted that it was owing Donarson, the sum of N35,237.90 and will pay up before December 31, 2018 but again defaulted.

The Defendant has also leased out some parts of the building to Akwa Ibom State government parastatals.

The plaintiff is seeking for the following reasonable sums, N35,409,237.98 for specific damage, award of N3,600,000 in avoidable legal cost expended in recovering the liquidation sum in the action, exemplary damage of N25,000,000, damages for breach of contract at N16,000,000 and 10 percent per annually post-judgment sum until judgment is executed.

The matter is fixed for further mention on the 24th July 2019
