A market woman in Anambra State, Adaeze Okpala, has sued a first generation bank for allegedly stealing from her account.

Okpala, who said N200,000 was deducted from her account without authorisation, is claiming the sum of N5m as general damages from the bank.

The matter, Southern City News gathered, is pending before an Onitsha High Court presided over by an administrative judge.

A court source said, “She is asking the court to compel the bank to pay her N5m as general damages for the illegal/unauthorised withdrawal of a total sum of N200,000 from her account between August and October 2016 at N10,000 per withdrawal.

“In the suit filed at the High Court Registry, the plaintiff, in her statement of claim, is seeking an order of the court mandating the defendant to return/re-credit her savings account with the sum of N200,000 being the amount illegally withdrawn from her account on various dates.

“The plaintiff is also seeking an interest of 21 per cent per annum on the sum of N200,000 illegally withdrawn from the account from August 1, 2016 till judgment is delivered in the case.

“And that the court should equally order the bank to pay her another 21 per cent interest of N200,000 from the judgment date till the account is credited to her account thereof.”

It was further gathered that Okpala had also stated that she had an ATM card but had never withdrawn or had any transactions with it since the issuance of the card to her. She said she had also not revealed her pin number to anyone.

She maintained that the day she received a debit alert for the first time, she had rushed to the defendant’s branch office to complain and request that her account should be blocked to forestall further withdrawals.

“But it took the defendant about two weeks to block the said account as it deliberately delayed in blocking the account as requested, which gave room for further unauthorised withdrawals from the said account,” she stated.

The unnamed market woman further averred that she formally wrote a letter to the defendant’s branch manager on November 1, 2016, complaining of the illegal withdrawals of the total sum of N200,000 from her account, but the official deliberately refused, failed and neglected to act upon the said letter or reply same, prompting her decision to approach the court on the matter.
