Discrimination is the practice of treating one person or group different from another in an unfair way. The act of Federal Government of Nigeria advertising jobs by their parastatals and placing age limit is widespread discrimination against particular age people in job market. The further stipulates that a person would not be subjected either expressly by, or in the practical application of, any law in force in Nigeria, or any executive or administrative action, of government to disabilities or restrictions to which citizens of Nigeria of other Communities, ethnic groups, places of origin, circumstance of birth, sex, religions, or political opinion are not made subject. Subsection (2) of the Constitution stipulates that “No citizen of Nigeria shall be subjected to any disability of deprivation merely by reason of circumstances of his birth.”  By virtue of the age limit place by Federal Government in their various job vacancies, Section 42(2) of the 1999 Constitution has been breached. Employment discrimination is a form of discrimination based on race, gender, religion, national origin, physical or mental disability, age, sexual orientation, and gender identity by employers. Labour market discrimination is defined as the different treatment of two equally qualified individuals on account of their gender, race, age, etc. This act is harmful by the Federal Government especially when two individuals are qualified for a job and one is discriminated against on account of age, this no doubt would affect the productivity income directly or indirectly and the Fundamental Human Right of the citizen has been breached. Discrimination is one of the sources of inequality in the labour market and a breach of the applicant’s right. Equality is injustice administered to fairness, the spirit or habit of fairness in dealing with other persons. In Canada they have a law called Employment Equity Act; this Act defines what employment equity is. Employment discrimination law in the United States derives from the Common Law which is codified in Civil Rights Act 1964, these laws prohibit discrimination based on certain characteristics, these laws prohibit employers from discriminating against employees/applicants on the basis of race, sex, origin, disabilities, age, etc. Also, the United Kingdom Labour Law makes it unlawful to discriminate against a person because they have one of the “Protective Characteristics” which are age, disability, gender, marriage etc. Equality Act 2010 in United Kingdom outlaws discrimination in access to education, public service, employment etc. Discrimination is unlawful, when the Federal Government/State Government is hiring and they are putting terms and conditions in regard to age where access to education is burn heavily by the citizen’s people parents, after getting the needed education and meeting all caterias of qualification, age factor would now be put into consideration, this act amount to treating a person less favourable than another who lacks the protective characteristics and it would led to age falsification, this unjustifiable and unconstitutional. Every act of discrimination which range from age, marriage, colour, religion are against Section 42 of the 1999 Constitution (as amended) and any disqualification of a person under any government directives is null and void.]]>
