Canada has clarified its citizenship rules for people born outside the country, stressing that citizenship claims by descent depend on a direct family line from a Canadian parent and the citizenship status of each person in that chain at the time of birth.

Under the rules, people born abroad may be recognised as Canadian citizens if they can establish an unbroken connection through a parent, grandparent or other direct ancestor who was a Canadian citizen when the next generation was born.
The clarification emphasises that citizenship can only pass through a direct line of descent. This means that relatives such as aunts, uncles, cousins or other family members who are not direct ancestors cannot transmit Canadian citizenship.
In a post on CanadaVisa’s X account on Friday, it was explained that citizenship by descent is based on the relationship between a child and a parent who held Canadian citizenship at the time the child was born.
“The Citizenship Act recognises a person born abroad to a parent who was a citizen at the time of the birth,” the post read.
The clarification follows changes introduced after legal challenges to previous limits on citizenship by descent, which were said to have unfairly prevented some descendants of Canadians from being recognised as citizens.
The updated position means that some people who were previously considered ineligible may now be recognised as Canadian citizens from birth, instead of only acquiring citizenship from the date of an application.
However, eligibility depends heavily on dates. A parent who became a Canadian citizen after a child was born cannot normally pass citizenship to that child through descent.
“If your parent was granted citizenship after you were born, that citizenship does not pass to you through descent,” the post added.
The rules also distinguish between different types of family relationships. Marriage to a Canadian citizen does not automatically confer citizenship, while adoption by a Canadian citizen follows a separate legal process.
Applicants seeking to confirm whether they are citizens by descent are advised to begin by identifying the oldest ancestor in their family who was born in Canada and then trace the citizenship connection forward, one generation at a time.
For those who meet the requirements, the process does not create a new citizenship status but confirms one they may already have held since birth.
“The certificate is just the part that confirms this status,” the post noted.
