The Nigerian Bar Association (NBA) Remuneration Committee, led by Chief Emeka Obegolu, PhD, SAN, and Rachael Princewill, has formally urged the Enugu State House of Assembly to incorporate the Legal Practitioners Remuneration Order 2023 into its proposed bill Landlord and Tenant Law, CAP. 101, Laws of Enugu State, 2024, on pegging agents, legal fees, and the elimination of caution fees.

This move aims to align state legislation with national standards, ensuring fairness, transparency, and economic sustainability for legal practitioners in Enugu State.

In a letter addressed to the Honorable Speaker of the Enugu State House of Assembly, the NBA Remuneration Committee commended the Assembly for its efforts to improve tenancy documentation and boost public confidence in legal processes. However, the Committee emphasized the need to integrate the provisions of the Legal Practitioners Remuneration Order 2023, which was signed into law on May 16, 2023, by the Honorable Attorney General of the Federation and Minister for Justice.

The Order, established under the Legal Practitioners Act (Cap L11, LFN 2004), provides a standardized framework for the remuneration of legal practitioners. It aims to ensure that legal fees are fair, transparent, and consistent across the profession, while also promoting professionalism and accountability.

The NBA’s request highlights the importance of harmonizing state laws with national standards to create a unified and equitable legal system. By incorporating the Remuneration Order 2023 into the proposed bill, the Enugu State House of Assembly can:

  1. Standardize Legal Fees: Establish clear benchmarks for legal fees to ensure equitable compensation for legal practitioners.
  2. Enhance Professional Integrity: Provide clear guidelines that promote professionalism and accountability in legal practice.
  3. Support Economic Sustainability: Safeguard the financial interests of legal practitioners, ensuring the continued delivery of high-quality legal services.

Chief Emeka Obegolu, PhD, SAN, and Rachael Princewill reiterated the NBA’s commitment to supporting the Enugu State House of Assembly in this legislative process. The Committee expressed its readiness to provide further clarification or engage in discussions to assist in the drafting of the bill. A copy of the Legal Practitioners Remuneration Order 2023 was also attached to the letter for the Assembly’s reference.
