The eight branches of the Nigerian Bar Association (NBA) in Rivers State have issued a joint press statement regarding the upcoming local government elections scheduled for Saturday, October 5th, 2024. The chairmen of the NBA branches stressed the legitimacy of the elections and encouraged peaceful participation from all eligible voters.

In the statement, the NBA leaders emphasized that local government elections are a fundamental part of Nigeria’s democratic process, as enshrined in the Constitution of the Federal Republic of Nigeria 1999 (as amended). They asserted that there is no legal impediment to conducting the elections in Rivers State, despite conflicting court judgments circulating on social media.

“While we do not want to over flog the issues on ground, or stoke the embers already burning, we must reiterate that the Constitution of Nigeria is the grundnorm from which all Government agencies and institutions derive their validity and are bound to obey same,” the statement read. “Any Law or judgment that is inconsistent with the provisions of the Constitution is null and void, to the extent of its inconsistency.”

The NBA leaders also called upon security agencies to uphold their constitutional duty of maintaining law and order during the election process. They warned that failure to carry out this role would undermine both democracy and the Constitution.

The eight NBA branches in Rivers State announced that they would participate in the election process as observers to promote transparency and accountability. They encouraged all registered voters in the state to exercise their franchise peacefully on election day.

“We further advise Rivers indigenes and residents in the State to be peaceful and law abiding in the course of the election process,” the statement concluded.

(Isiokpo), Abiye A. Abe, Esq. (Degema), Dr. N. A. Duson (Bori), Dr. Celestine Nwankwo (Okehi), Tamunosihi A. Roberts, Esq. (Okrika), and Ekeledinichukwu Ordu, Esq. (Omoku).

As the election date approaches, the NBA’s call for peaceful participation and respect for the rule of law resonates with the aspirations of the people of Rivers State for a free, fair, and credible democratic process.
