The Legal Practitioners Disciplinary Committee (LPDC) issued a warning to Mr. Ayodele Babalola, a legal practitioner, for engaging in professional misconduct. The case, with complaint number BB/LPDC/421/2021, was brought before the committee by Mrs. Bolanle Tijanee, the complainant, against Mr. Babalola.

The complaint arose from a land transaction in which Mr. Babalola allegedly sold a plot of land to Mrs. Tijanee in 2012 for the sum of N350,000. However, when Mrs. Tijanee attempted to take possession of the land, the rightful owners emerged and claimed ownership, despite the fact that she had already commenced construction on the plot.

Upon confronting Mr. Babalola, he admitted that the land did not belong to his clients and offered to refund the money. He initially refunded N150,000, leaving a balance of N200,000 unpaid. In 2018, Mr. Babalola issued a cheque to Mrs. Tijanee for the remaining balance, but the cheque was dishonoured when presented.

The LPDC, chaired by Hon. Justice Dr. Ishaq Bello, OFR, and comprising other distinguished members, heard the case and reviewed the evidence presented by both parties. The committee found that Mr. Babalola’s actions, including the issuance of a dud cheque and the delay in refunding the complainant’s money, constituted infamous conduct in a professional respect.

In its direction, the LPDC emphasized the importance of Rule 1 of the Rules of Professional Conduct, which requires lawyers to uphold and observe the rule of law, promote and foster the cause of justice, maintain a high standard of professional conduct, and refrain from engaging in any conduct that is unbecoming of a legal practitioner.

The committee noted that Mr. Babalola’s conduct fell short of the expected standards and amounted to a betrayal of the trust and confidence reposed in him as a professional lawyer. The LPDC stressed the need to protect the image of the legal profession and maintain high professional standards.

Consequently, the LPDC issued a warning to Mr. Ayodele Babalola, finding him liable for professional misconduct. The committee emphasized that disciplinary sanctions serve as a means for the bar to control the conduct of legal practitioners and jealously guard its reputation for the maintenance of high professional standards.
