The Section on Public Interest and Development Law (SPIDEL) of the Nigerian Bar Association (NBA) has filed a motion seeking the recusal of the NBA President, Yakubu Chonoko Maikyau, from presiding over the National Executive Council (NEC) meeting holding in Jos, Plateau State.

In the motion dated February 26th, brought before NBA-NEC by SPIDEL, it was stated that there is an ongoing misunderstanding and dispute between the Section and the President over SPIDEL’s authority to independently design and execute its activities without requiring the President’s advance approval.

The Section argues that allowing the President to preside over NEC meetings where this dispute will be discussed violates principles of natural justice since he would be “a judge in his own cause.”

SPIDEL contends that the President, as the aggrieved party who has previously attempted to suspend the Section’s activities, cannot provide them fair hearing on this issue, which contravenes constitutional fair hearing protections.

The motion urges NEC to recuse the President from meetings discussing this dispute to uphold the NBA’s commitment to the rule of law and safeguard the rights of its members.

SPIDEL’s Chairman J.O. Aikpokpo-Martins and Secretary Funmi Adeogun signed the motion dated February 26th, which will be heard at the NEC meeting in Jos on February 29th.
