A non-profit focused on data privacy rights has filed a lawsuit against Nizamiye Hospital in Abuja, alleging violations of Nigeria’s recently enacted data protection laws.

In an originating summons filed at the FCT High Court, the Incorporated Trustees of Personal Data Protection Awareness Initiative claimed the hospital failed to provide privacy notices when collecting patient’s data The group said it discovered Nizamiye Hospital is using CCTV cameras , its website to capture patients personal data, without notification and patients were given forms seeking personal information without abiding by the fair processing information provision requirment of the Nigeria Data Protection Act(NDPA), 2023.

The privacy non-profit argues these actions violate requirements in Nigeria’s 2023 Data Protection Act, which mandates data controllers like Nizamiye Hospital to be transparent in informing patients what personal data is collected, the purposes it is used for, retention periods, and more. The group noted the trove of Sensitive Personal Data that medical hospitals handle and the need to conduct Data Protection Impact Assessment (DPIA) for some of the high-risk processing.

The group through its legal counsel Okani Emmanuel of E.I.Okani & Associates seeks court declarations that the hospital breached the provisions of NDPA data handling requirements, an order compelling Nizamiye Hospital to comply with privacy protection regulations, damages, and other relief.

The case puts an early spotlight on Nigeria’s emerging data protection framework modelled after the EU’s GDPR privacy law.
