*Certificate Won’t Be Released, Until My Brief Is Perfected, Lawyer Insists

Lagos-based businessman, Mr. Damasus Onuoha Ukah has cried out for intervention against a Legal Practitioner, Orbby Venessa Agwuncha, Esq., over her failure to deliver after 2 years, the registration document at the Corporate Affairs Commission of his company, Privado-Billions-Int’l Limited.

In a chat with TheNigeriaLawyer, Mr. Damasus confirmed that truly, the certificate of Incorporation and other documents for the registration have been completed by the Lawyer since December, 2018 but yet to be made available to him, inhibiting the doing of his business.

“Orbby Vanessa Agwuncha helped me (to) do a company registration (name: Privado-Billions-Intl-Ltd ) which she concluded by DEC 23, 2018.

“From then till this minute, she has refused to make my CAC documents available to me which has made it impossible for me to use the documents or the company for business”, he said.

In addition, he stated that he has made several attempts “to massage her ego just to have my CAC documents in my hand before running 3000 miles away from her”, adding that he was blocked by her on WhatsApp.

“Meanwhile, she has blocked me off on her two WhatsApp lines simply because I want my CAC documents”, he stated.

Also, he noted that all these are happening “after paying her full N40,000 she charged me.”

He stated that this payment was done by first making an initial payment of N30,000 after which he sent the remaining balance of N10,000.

In a WhatsApp conversation he made available to TheNigeriaLawyer, the certificate of registration evidencing the availability of the document was sent to him on 24th day of December, 2018 by 4:11PM, confirming that “a dispatcher will come pick up”.

However, upon repeated demands from the WhatsApp conversations, he said he was bothered as to why he was going “through this harrowing experience at your hand for something that means literally nothing”, adding that, “But this I must say is one experience I’d remember for a very longtime.”

Meanwhile, she insisted that his certificate has been ready “exactly 3 weeks of filing…that you have not received it doesn’t make it unready”.

On 17th January, 2019, she said the certificate will be received by her whilst confirming on 29th December, 2018, and subsequently, on 23rd January, 2019, that his certificate will be dispatched to him.

On 9th day of February, 2019 she confirmed that the certificate is in her office, stating that same is being sent on 12th day of February, 2019.

TheNigeriaLawyer came to the realization that he was blocked from her two WhatsApp lines belonging to her on two separate occasions, April and 26th August, 2020.

“I feel the CAC documents are lost in transit from the inconsistent tales she painted from Lagos to PH to Abuja , okada to flight to bus… to Ekeson Motors, etc. Too many lies and deception.” He said.

In another development however, TheNigeriaLawyer in a telephone conversation with the Lawyer, Orbby Venessa, Esq., she stated that what was painted is not the complete assemblage of facts as narrated by Mr. Damasus.

She stated that truly, the registration is completed and verifiable. But however, she has refused to deliver the document.

She stated that he is yet to get his certificate because of two reasons, the Corona Virus pandemic which had disrupted the smooth doing of business on the one hand and that her brief is yet to be perfected on the other.

“I am holding it because he is owing me”, she said, adding that he was charged N60,000 of which he only paid the sum of N40,000 and stated that “I don’t do charity”, because it is an official work.

Therefore, she said that until the balance is paid, he won’t be given the document.

She further added that her Secretary had earlier sent the document through DHL but because it was wrongly addressed, it was returned back to the office.

Reacting to why she blocked him from her WhatsApp lines, she noted that messages coming from him are too much, adding that she can always be reached by him either through phone calls or text messages.

In contrast however, Mr. Damasus retorted that the agreement between them is the payment of N40,000 and not N60,000 as she stated.

“Where was this N60,000 stated?? In chats, conversation or what??? Our agreement was N40,000 fully paid”, he said.

Meanwhile, he noted that although their agreement is N40,000, but if she insists on collecting an “unknown” balance of N20,000, he is ready to pay but with the assistance of an intermediary, noting that the document should be delivered to the third party and then he pays to ensure the document still actually exists and have not been lost.

“I’m having very wrong impression of Nigerian lawyers until this professional approach you guys are showing me now. Believe me!”, he said.
