Adebayo is facing a count charge of murder. The prosecutor, Sgt. Duro Adekunle, told the court that the defendant committed the offence on July 31, at Abidogun Zone 7 area of Osogbo. Adekunle said that the defendant flogged his son, Uthman Adebayo to death after the son stole a belt belonging to a neighbour. He said the offence contravened Section 319(1) of the Criminal Code, Cap 34 Vol. 11 Laws of Osun, 2003. Defence counsel, Mudashiru Balogun, prayed the court to grant his client bail in the most liberal terms. Balogun said that the case file released from the office of the Directorate of Public Prosecutions (DPP), indicted a manslaughter charge against his client. The plea of the defendant was not taken. The Magistrate, Mrs Fatimoh Sodamade, ordered remand of the defendant in police custody and amendment of the charge to reflect manslaughter as indicated by the DPP.
