Oseni Iyere was arraigned before the court on three-count charge which bordered on obtaining money by false pretences and conversion of business money to personal use by the Economic and Financial Crimes Commission, EFCC. Odunuga, the third prosecution witness and a Territory Manager with Mobil Oil Nigeria Plc, narrated to the court presided over by Justice Mojisola Dada that the appointment of Oseni Iyere had already been ended before the defendants used the company name to defraud Terry-Christa Energy Limited to the tune of N32 million. According to the charge preferred against the defendant by EFCC, the defendant allegedly obtained the sum from the complainant pretending to be the owner of Mobil Petrol Station at 93, Akpakpara Road, Benin City, Edo for the purchase of petroleum product. He however denied the charges. Led in evidence by the Prosecution Counsel, Zainab Ettuh, the witness said the defendant’s appointment agreement which was renewed basis on a monthly basis, was terminated when he did not meet up with demand. He further said that the company wrote a letter to the defendants to that effect which he responded with a letter of plea which Mobil turned down. The two letters are part of evidence admitted tendered as exhibit in the trial. The Defence Counsel, Mr. Seth Ametule, sought for an adjournment to review the evidence of the witness so as to be able to cross-examine the witness. EFCC Counsel, Mrs. Zainab Ettuh, however, opposed the oral application on the grounds that the witness does not reside in Lagos. “My Lord, the Defence Counsel ‘s prayer is an attempt to frustrate accelerated hearing on this matter,” says Ettuh. Justice Dada who was not pleased with the application of the Defence Counsel gave a note of warning while adjourning till July 3 for continuation of trial.]]>
