*Says Order Was Advice From Bank

A Notary Public, Anthony Eruaga, has written the Guaranty Trust Bank withdrawing the letter he earlier wrote directing it (the bank) to reverse a money wrongly transferred by one Deborah Oluwabukola Babatunde

In a letter sighted by TheNigeriaLawyer dated May 28, 2021, the lawyer said the order was made outside his power.

“By the extant law of Notary Public I lack the power to make judicial order,” he said.

He explained that he inadvertently wrote the notarized reversal order because courts were not in session.

“That am by this letter withdrawing the original copy of the Notarized Reversal Order dated 26th May 2021.

“That the Bank and the general public should discountenance it,” Eruaga stated.

Recall that Eruaga had directed the Guaranty Trust Bank to reverse a money wrongly transferred from Kuda Bank to GT Bank.

The purported order in question, which was sighted by TheNigeriaLawyer, is dated 26th May, 2021 between one Deborah Oluwabukola Babatunde and Guaranty Trust Bank PLC.

The order states that application for the transaction reversal was made orally for “An order of the office of the Notary Public praying for the reversal of the sum of N5551,250,00 (Five Hundred and Fifty One Thousand Two Hundred and Fifty Naira) only wrongly/erroneously paid by Deborah Oluwabukola Babatunde – Account No: 2000632834 via Kuda Bank into account no:0023457325, with the name- Ofoedu Gabriel Chikubuikem GTB Account instead of Account No: 0032457325, Name – Arisokwu Charity Amarachi GTB Account.”

The Notary Public, therefore, orders that the said sum be reversed.

“It is hereby ordered that the sum of N551,250.00 (Five Hundred and Fifty-One Thousand Two Hundred and Fifty Naira) only wrongly/erroneously paid by Deborah Oluwabukola Babatunde Account No:2000632834 via Kuda Bank into account 0023457325, Name – OFOEDU GABRIEL CHUKWUBUIKEM GTB be reversed back to Account No: 2000632834 belonging to Deborah Oluwabukola Babarurde.”

The letter elicited mixed reactions from legal practitioners who described the order as unlawful.

Consequently, Eruaga urged the public to disregard the letter because it was done in error.
