The claimant, through its lawyer Chief Anthony Idigbe (SAN), is urging the court for a declaration that it is entitled to control and manage the facilities of Alpha Bay Estate. It’s also asking the court to declare that the management of the estate by Admiralty Homes was illegal and constitutes a breach of agreement between the claimant and the defendants. The claimant further sought for an order directing the companies to hand over the estate’s management to the residents’ association pursuant to the agreement, as well as an order directing the companies to remit to it all estate dues paid by some residents from November 2013 till date. The complaint wants the court to perpetually restrain the defendants from interfering with its control of the estate and from constructing any structures on same. r set out access roads, drainages, common areas, or further conversion of estate facilities for private use.
